Galati’s Hideaway

Terms of Service

Last updated: November 3, 2026

These Terms of Service (the “Terms”) govern your use of galatis.com (the “Website”) and the products and services offered through it by Galati’s Pizza & Pasta Inc., d/b/a Galati’s Hideaway, an Illinois business located at 800 Feinberg Ct., Cary, Illinois 60013 (“Galati’s,” “we,” “us” or “our”). Please read these Terms together with our Privacy Policy, which describes how we collect and use your information and is incorporated into these Terms by reference.

1. Acceptance of These Terms

By accessing or using the Website, placing an order, purchasing a gift card, or submitting an inquiry or application, you agree to be bound by these Terms. If you do not agree, please do not use the Website. You must be at least 18 years of age, or have the consent of a parent or guardian, to place orders or make purchases.

2. Use of the Website

You may use the Website for lawful, personal and non-commercial purposes, such as viewing our menu, placing orders, purchasing gift cards, planning an event or contacting us. You agree not to:

  • use the Website in violation of any applicable law or regulation;
  • interfere with, disrupt or attempt to gain unauthorized access to the Website, its servers or related systems;
  • transmit spam, viruses, malicious code or other harmful material; or
  • copy, scrape or harvest content or data from the Website by automated means.

We may suspend or restrict access to the Website at any time, without notice, if we reasonably believe these Terms have been violated.

3. Menu, Pricing and Availability

We make reasonable efforts to keep the menu, prices and other information on the Website accurate and current. Menu items, ingredients, prices and availability are subject to change without notice, and items may occasionally be unavailable. The prices shown in our point-of-sale and online ordering system at the time of your order, or charged at the restaurant, govern. If the Website contains a pricing or typographical error, we are not bound by the erroneous price. Photographs are for illustration only, and actual items may vary in appearance.

4. Online Ordering, Delivery and Payment

Ordering platform. Online orders for pickup or delivery are placed through our ordering system provided by Heartland at galatis.hrpos.heartland.us/menu. Payments are processed by Heartland and its payment processors, and their terms and privacy policies apply to your use of those services. We do not store payment card numbers on the Website.

Delivery. We deliver food and non-alcoholic beverage orders placed directly with us within a 6-mile radius of the restaurant; alcohol is not available for delivery (see Section 5). Catering delivery is described on our Catering and FAQ pages. Quoted pickup and delivery times are estimates only and may be affected by weather, traffic, order volume and other conditions beyond our control. You are responsible for providing an accurate delivery address and for being available to receive your order.

Order issues. If an order placed directly with us is incorrect or unsatisfactory, we will remake the order. To qualify, you must notify us by calling (847) 516-3663 within one (1) hour of pickup or delivery.

DoorDash. We also accept orders through DoorDash. Alcohol is not available through DoorDash. Orders placed through DoorDash are subject to DoorDash’s own terms and policies, and DoorDash is responsible for its payments, fees, delivery and refunds.

5. Alcoholic Beverages

Alcoholic beverages are sold and served only to persons 21 years of age or older, in accordance with the Illinois Liquor Control Act of 1934 (235 ILCS 5) and applicable local ordinances.

In the restaurant and at events. A valid, government-issued photo ID is required to be served. We reserve the right to refuse or discontinue alcohol service to any person, including any person who cannot provide valid identification or who appears to be intoxicated.

No alcohol delivery. Galati’s does not deliver alcoholic beverages. Alcohol is not available for delivery by Galati’s, through DoorDash, or through any other third-party service.

Pickup orders. Alcoholic beverages may be included in orders picked up at the restaurant, where permitted by law. By ordering alcohol, you represent that you are at least 21 years of age. At pickup, the purchaser or the person picking up the order must be at least 21 years of age and present a valid, government-issued photo ID. Our staff will not release alcohol if a valid ID is not presented or if the person appears to be under 21 or intoxicated; in that case, the alcohol portion of the order will be cancelled. The price of any alcoholic beverage not released will be refunded to the original method of payment.

Alcohol for pickup is provided in sealed containers as required by law. Under Illinois law (625 ILCS 5/11-502), alcohol may not be transported in the passenger area of a vehicle unless it is in its original container with the seal unbroken. You are responsible for complying with all laws that apply to alcohol after it leaves our premises.

6. Gift Cards

eGift cards may be purchased online through Heartland at galatis.hrpos.heartland.us/gift and are delivered by email to the recipient you designate. Physical gift cards may be purchased at the restaurant or by calling (847) 516-3663. The following terms apply to all Galati’s gift cards:

  • Gift cards never expire, and we do not charge any dormancy, inactivity or other post-purchase fees.
  • Gift cards may be redeemed for online orders, banquets, catering and in-house purchases at Galati’s Hideaway.
  • Gift cards cannot be redeemed for cash, except where required by law.
  • Gift cards should be treated as cash. We are not responsible for, and cannot replace, lost, stolen or damaged gift cards, or gift cards used without your permission.

These terms are intended to comply with the Illinois Consumer Fraud and Deceptive Business Practices Act (815 ILCS 505/2SS) and other applicable law. If any provision conflicts with applicable law, the law will control.

7. Private Parties and Banquets

Inquiries are not bookings. A private party or banquet inquiry submitted through the Website is a request only and does not reserve a date, room or package. A booking is confirmed only when we confirm it with you directly (the “Event Confirmation”).

Date holds and deposits. We can hold your date for 48 hours without a deposit; after that, a $250 non-refundable deposit secures it. Funeral luncheons need no deposit and aren’t charged by the hour.

Event details and pricing. Room time, package pricing, guest minimums, gratuity, taxes and other event terms are described on our Banquets & Private Parties page and in your Event Confirmation. If the Website and your Event Confirmation differ, your Event Confirmation controls.

Final guest count and menu. You must provide your final guest count and menu selections by the deadline stated on our Banquets & Private Parties page or in your Event Confirmation. Charges for per-person food and beverage packages will be based on the final guest count, even if fewer guests attend.

Payment. Unless your Event Confirmation states otherwise, the balance for your event is due at the end of the event. Accepted forms of payment are listed on our Banquets & Private Parties page.

Cancellation and rescheduling. The deposit is non-refundable. Requests to cancel or reschedule must be made by calling (847) 516-3663 and are subject to availability and to the terms of your Event Confirmation. If an event is rescheduled, the $250 deposit may be applied to a rescheduled date confirmed by Galati’s, subject to availability. Any other conditions will be set out in your Event Confirmation.

Responsibility for damage. The person who books the event (the “Host”) is responsible for any damage to the rented room, its furnishings or equipment, or any other part of our premises caused by the Host, the Host’s guests or the Host’s vendors, including the reasonable cost of repair, replacement or extra cleaning.

Conduct and supervision. The Host is responsible for the conduct of all guests and vendors. Minors must be supervised by an adult at all times, and persons under 21 may not play video gaming machines. We may stop service, remove any person, or end an event early, without refund, if we reasonably believe conduct is unsafe, unlawful or disruptive, or violates these Terms.

Food and beverages. All food and beverages served at an event must be provided by Galati’s, except store-bought cakes and desserts, which are welcome, and except as we approve in advance. Outside alcoholic beverages are not permitted. All alcohol is served only by Galati’s staff, only to guests 21 years of age or older with valid photo ID, and we may stop serving any guest at our sole discretion.

Decorations. Decorations must not damage our premises. Unless we approve in advance, the following are not permitted: confetti, glitter, rice or similar loose materials; open flames; and nails, tacks, staples or tape on walls, ceilings or fixtures.

Outside vendors. Any outside vendor, such as a DJ, entertainer, photographer or decorator, must be approved by us in advance and must follow these Terms and our staff’s instructions. The Host is responsible for its vendors.

Items left behind. We are not responsible for loss of or damage to gifts, decorations, equipment or other personal property brought onto our premises or left behind after an event.

Events beyond our control. If we are unable to host an event because of circumstances beyond our reasonable control, including severe weather, fire, flood, utility failure, government order, public health emergency or similar events (“Force Majeure”), neither party will be liable for the failure to perform, and we will work with you in good faith to reschedule the event.

8. Food Allergies and Dietary Needs

If you or any guest has a food allergy, intolerance or dietary restriction, please inform your server, the person taking your order, or our event staff before ordering. Our kitchen prepares many foods that contain common allergens, and shared preparation areas and equipment are used. We therefore cannot guarantee that any item is free of allergens or cross-contact. Menu descriptions may not list every ingredient.

9. Video Gaming

Our sports bar offers Illinois video gaming. Only persons 21 years of age or older may play. Information about gaming machines on the Website is provided for general interest only, is based on manufacturer descriptions, and may change as game lineups change.

Must be 21 or older to play. Gambling problem? Call 1-800-GAMBLER.

10. Forms, Applications and Submissions

When you submit an inquiry, job application, message or other information through the Website, you represent that it is accurate and that you have the right to provide it. Please do not submit payment card numbers, Social Security numbers or other sensitive personal information through Website forms. We handle submitted information as described in our Privacy Policy.

Submitting an application through our Join Our Team page does not guarantee an interview or offer of employment. Galati’s Hideaway is an equal opportunity employer.

If you send us ideas, suggestions or feedback, you agree that we may use them without restriction or compensation to you.

11. Intellectual Property

The Website and its content, including the Galati’s Hideaway name and logo, text, photographs, graphics and design, are owned by or licensed to Galati’s and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify or use any content for commercial purposes without our prior written permission. You may share links to the Website.

12. Third-Party Websites and Services

The Website contains links to services operated by third parties, including Heartland (online ordering and gift cards), DoorDash, Google (maps and reviews) and social media platforms. We do not control and are not responsible for the content, policies, practices or availability of those services. Your use of them is governed by their own terms and privacy policies.

13. Disclaimer of Warranties

The Website and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, error-free or free of harmful components, or that information on the Website (including hours, menus, prices and event details) is complete or current at all times.

14. Limitation of Liability

To the fullest extent permitted by law, Galati’s and its owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Website or any third-party service linked from it. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Illinois law.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Galati’s and its owners, officers, employees and agents from any third-party claims, losses, damages and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms or applicable law, your misuse of the Website, or, if you are an event Host, the conduct of your guests and vendors or damage they cause, except to the extent caused by our own negligence or willful misconduct.

16. Changes to These Terms

We may revise these Terms at any time. Revisions take effect when posted on the Website, and the “Last updated” date above will be changed. Your continued use of the Website after revised Terms are posted constitutes your acceptance of them. Revisions will not affect orders placed or events confirmed before the revision is posted.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state courts located in McHenry County, Illinois, or the federal courts for the Northern District of Illinois, and you consent to the jurisdiction of those courts.

18. General Provisions

Entire agreement. These Terms, together with our Privacy Policy and, for events, your Event Confirmation, constitute the entire agreement between you and Galati’s regarding their subject matter. If these Terms conflict with an Event Confirmation, the Event Confirmation controls for that event.

Severability. If any provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent.
